The agreement between us when you book training: what we provide, what we need from you, and what happens if plans change.

These terms apply to your use of this website and to the motorcycle training we provide. Please read them before you book: by booking a course with us you agree to them. Nothing here affects your legal rights as a consumer.
The training terms below reproduce Bryans Motorcycle School's Terms and Conditions as revised 8 August 2024. If you only read one section, make it changing or cancelling: the notice we need is longer than most people expect, and Saturdays do not count towards it.
Who we are
Bryans Motorcycle School provides motorcycle training from Bet 365 Stadium, Stanley Matthews Way, Stoke-on-Trent, Staffordshire ST4 4EG. Where these terms say "we", "us" or "our", that is who they mean. "You" means the rider taking the training, or the person booking it on their behalf.
You can reach us on 01782 595000 or at ride@bryansmotorcycleschool.co.uk. If we need to contact you, we will use the phone number or email address you gave us when you booked.
Using this website
The site is free to use, and we may change or withdraw any part of it. We try hard to keep it accurate, but course details, prices and availability do change. Nothing on the site is an offer to contract, and a booking is only formed as described below.
The text, photographs, logos and design on this site belong to us or are used under licence. You are welcome to read it, print it and link to it. You may not copy or reuse it commercially without our permission.
Please do not misuse the site: no attempts to gain unauthorised access, no automated scraping, and nothing unlawful or abusive sent through the contact form.
We link to other websites, including booking or payment providers, our partners, and GOV.UK for licence and test information. We are not responsible for the content of those sites or for what happens on them.
Making a booking
You can enquire through the contact form, by phone, by email, or through the "Book now" link on a course page where that course has one. Some courses link out to a separate booking or payment system run by another company; that provider's own terms apply to the transaction itself, and these terms apply to the training.
We must have received payment in full before your place is booked. Once we have, we will send you an email confirmation of the course, along with these terms, provided you have given us a working email address. That confirmation is the point at which a contract is formed between us. Until then we cannot hold a date for you.
Read these terms before your cancellation deadline passes. If you book inside the cancellation window set out below, we will tell you at the time of booking the date and time by which we need notice. That is usually midday on the day after you booked.
We may decline a booking, for example where there is no availability or where the requirements below cannot be met. If we do, we will refund anything you have paid.
Courses, lessons and prices
Prices shown on the site are a guide and are confirmed to you when we confirm your booking. What each course includes, and how long you get, is set out on that course's page.
We sell both individual lessons and complete courses. A course is sold as a whole block booking: we cannot refund part elements you did not attend, and once a course is paid for and confirmed it cannot be re-sold or transferred to someone else.
A CBT runs for 6 hours, either in one day or as an agreed split course. If your CBT is not completed within those 6 hours, further sessions are chargeable, covering both tuition and bike hire.
DVSA theory and practical test fees are set by DVSA and are separate from our course fees, unless we have told you in writing that they are included in a particular course.
We may occasionally need to change a course's content, duration, instructor or start time. If a change is significant we will tell you and you can move to another date or cancel for a full refund.
What you must bring
On the day of your training you must hold, and have with you, a valid UK driving licence with the correct provisional category. You also need to create a licence check code on GOV.UK and bring either a printed copy or a photo of it on your phone.
If you hold an old-style UK licence with no photocard, check it carries the correct provisional category and bring a valid, in-date passport to prove who you are, along with your check code. No other form of licence or ID is acceptable, and no copies.
Where you hold them, you must also bring:
- your motorcycle theory test certificate;
- your CBT certificate (DL196), once it has been issued.
Bringing these documents to every session you attend is your responsibility. If you cannot produce them, training may be stopped for that day and the fees for that day are lost. Depending on the course, that can mean losing the whole course fee.
Eyesight
You must be able to read a vehicle number plate from 20.5 metres (67 feet), with glasses or contact lenses if you need them, and you must wear them throughout training. We take no responsibility if this standard is not met, and training fees will be lost.
Highway Code
You must have read and understood the current Highway Code, including the rules, regulations and traffic signs in it. If you have not, training may be halted and fees may be lost.
Theory test
You do not need a theory test for a CBT. For any full licensing test, you must hold a motorcycle theory test pass certificate at least 14 working days before the practical element can be taken. Without one, DVSA cannot let you sit the accompanied riding test. Book your theory test directly at gov.uk; we recommend the DVSA Official Motorcycle Theory Handbook.
Food and drink
Sustenance is your own responsibility. We recommend a packed lunch and drinks for every course, and please bring any cutlery you need, as we cannot supply it.
Attendance and timekeeping
You must attend all of your scheduled training, in full and on time. Please allow for traffic and transport problems, and arrive 15 minutes before the start time so there is time to book in and kit up before the course itself begins.
Our courses are regulated by DVSA and follow a set syllabus, so they cannot be delayed or postponed for one rider. If you are late, your instructor will carry on with the scheduled session to meet the other riders' needs. Arriving late can mean missing your session altogether and forfeiting your fees, and you will not be reimbursed for training you missed by arriving late.
Where your course includes licence acquisition, you must take the test booked as part of it, provided you are safe to do so. We cannot offer refunds or compensation for missed sessions or tests, and if you miss elements of your timetabled training your course may be terminated with no refund.
How we count working days
Every notice period on this page is counted in working days, and it is worth being precise about what that means:
- Working days are Monday to Friday, 9am to 4pm.
- Saturday is not a working day, and neither is Sunday.
- Bank holidays do not count.
Notice means giving us at least that many full working days in which to reschedule. It must also be given in a way we can properly record and act on, which in practice means a phone call to a sales advisor on 01782 595000, so it can be logged on our system. Email is fine, but we only read it on weekdays, so allow extra days if you use it.
Changing or cancelling
Notice periods exist because a cancelled place is hard to fill: they let us recover test fees, meet DVSA and instructor requirements, offer the place to another rider, or move the instructor and bike elsewhere. If we do not get enough notice, the session runs with a space held for you whether or not you attend, and the fee is not refunded.
CBT
- 7 working days' notice to cancel and receive a refund, less a 10% administration charge.
- 5 clear working days' notice to move your CBT to another date.
Multi-session courses and courses including a DVSA test
- 14 working days' notice to receive a refund, less a 10% administration charge or the deposit, whichever is greater.
- Cancelling after that point means the course fees are lost.
Intensive courses
- 31 working days' notice to cancel.
DVSA practical tests
Once a test date is allocated, 14 working days' notice is required to move or cancel it. With less notice, the test fee and the session fee are both forfeit and you will need to re-book and pay for a new session and test. That is DVSA's rule, not ours, and we cannot waive it.
Courses that have already started
We cannot offer a refund, or a part refund, once a course has begun. Courses are sold as a block booked package, and attending the dates as booked, or giving sufficient notice, is the rider's responsibility.
If you are ill or something serious comes up
If illness, injury or other personal circumstances stop you attending a course you have booked, the fee for that training is still payable and we cannot offer a refund. As a matter of goodwill we will provide a receipt for your course and written confirmation that you did not attend, so you can claim on any insurance you hold. We do not provide or arrange insurance for these circumstances.
Your 14-day right to cancel
If you booked at a distance, meaning online, by phone or by email rather than in person with us, you normally have 14 days from the day we confirm your booking to change your mind and cancel for a full refund. This right comes from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. It sits alongside the notice periods above, and where the two differ, whichever is better for you applies.
If you ask us to start your training within those 14 days, you can still cancel, but we may charge you a fair amount for the training already provided. Once a course has been provided in full at your request within the 14 days, the right to cancel is used up.
To cancel, just tell us; an email or a phone call is enough. We will refund you by the same method you paid, within 14 days of you telling us.
If we or DVSA have to cancel
We and DVSA both reserve the right to alter course and test dates and times. If your dates or your test have to be rescheduled because of adverse weather or any other extenuating circumstance, we will move them to the next available date. Safety comes first, and we will not run a session in conditions we do not think are safe to ride in.
Refunds and compensation cannot be given for rescheduling, whatever the circumstances. We are also not able to cover other costs you may have arranged around a session, such as travel or time booked off work.
Where a course includes a DVSA practical test, we book that test on your behalf, but it is an external examination run entirely separately from us. DVSA can and do cancel tests at short notice, relocate them, change the time, date, format or price, or lose them to examiner or vehicle problems. That list is not exhaustive. We will do everything we reasonably can to manage this around you, but where DVSA offers no compensation we cannot compensate you, provide free training, or accompany you to a rearranged test free of charge.
Progress, gaps and re-tests
Gaps between sessions
For your safety and your instructor's, the longest gap allowed between training events on a course is 8 weeks. After that we will require either a full CBT or an off-road familiarisation session, at our discretion, and that remedial training is chargeable.
Re-tests
If you fail your test, you must take at least one further training session in every 3-week period while you wait for the re-test, and your next test must be taken within 6 months. Beyond that, a full course is required to bring you back to standard, charged at full cost.
The cost of any additional training, further DVSA test fees, and any travel or subsistence, are your responsibility.
Direct Access upgrades
On a Direct Access course, the decision to move you up to the big bike rests solely with your instructor, and we will not upgrade you unless we are completely satisfied you can handle the machine safely. If we are not, we may restrict you to a 125cc or 400cc machine, and no refund is made. The same applies on any other course, whatever bike you had hoped to ride.
Occasionally a rider does not reach the standard needed to upgrade, or to complete the CBT element, within the timescales of a normal course. Your instructor will explain the alternatives, which may mean extra training or extra DVSA test costs and are subject to instructor availability, which we cannot guarantee. No refund is made where you are not able to complete your CBT or Direct Access course.
Kit and equipment
We loan helmets, gloves, jackets, trousers and boots. If we judge that you are not suitably dressed for riding, you will be required to wear our protective equipment for the whole of your training.
If you are riding your own bike, you must have at minimum a suitable helmet and gloves of your own if you intend to ride it home after your CBT.
Please take reasonable care of anything we lend you, and return it at the end of the session.
Training on your own motorcycle
If you train on your own machine, you must bring:
- proof of insurance;
- an MOT certificate, if the vehicle is over three years old;
- proof that the vehicle is currently taxed;
- your valid CBT certificate, if you are attending a post-CBT session.
The motorcycle must be in a roadworthy condition, and making sure it meets every legal requirement for being on the road is your responsibility. If you arrive on a machine that is not road legal, for example because the number plate or L-plate does not meet legal requirements, your instructor will not be able to conduct any on-road training. Your fee is not refundable in that situation and you will need to re-book and pay for any further lessons.
Health, fitness and safety
Riding a motorcycle involves a high degree of risk that can lead to personal injury or death. In booking a course or a lesson, you accept those risks and hazards.
You are obliged to tell us about any physical or medical condition, medication or anything else that could adversely affect safety or training, before you train and if anything changes later. We will do what we reasonably can to accommodate you. What you tell us is handled as set out in our Privacy Policy.
You are responsible for acting in accordance with the directions and advice your instructor gives you throughout your training, and for making sure you are adequately dressed and protected for riding.
We reserve the right to cancel tuition if we suspect you are under the influence of drink or drugs, or if you are not legal to ride on the road, for example if you fail the eyesight check. We can also stop tuition at any point where you are not safe on the road or are not following instructions. No refund is made in either case.
If at any time a rider shows an unsuitable attitude, takes unacceptable risks, or fails to follow instructions in a way that endangers themselves or others, the course may be terminated at that point and the fees forfeited. As a licensed DVSA assessor, your instructor has the final decision on this. We may, at our discretion, arrange further training at your full expense.
Any penalties or fines you incur while riding one of our hire bikes, arising from the way you rode on the road, will be charged directly to you.
Behaviour
We reserve the right to cancel a rider's course, or any part of their training, without refund, where an instructor, a member of staff or any third party is subjected to assault, abuse or threatening behaviour.
Threatening behaviour, whether physical or verbal, ends your training immediately. There is no appeal, your instructor's decision is final in every case, and no refund is given. This is rare, and it is about keeping the ground safe for everyone on it.
What we provide
For CBT and Direct Access courses, we provide practical motorcycle training in accordance with DVSA approved training standards.
Where you have hired a motorcycle from us, we provide one that is roadworthy and compliant with the law in England and Wales. We will try to meet your preference for model, but cannot guarantee it. We will provide a geared machine where you ask for one, but reserve the right to move you to an automatic for safety reasons, as determined by your instructor.
We cannot guarantee that you will pass. We will do everything we reasonably can to get you to test standard, but we give no guarantee that a CBT certificate will be issued or that you will pass module 1 or module 2. If you fail module 1 you may not be able to sit module 2, and the module 2 test fee is forfeit. Course fees pay for the training and the instructor's time, not for a particular outcome.
Insurance
If you are training on one of our motorcycles you are covered under our insurance, which is included in the course fee. If an accident is caused by your not following your trainer's instructions, you will be charged the insurance excess in the event of a claim.
Personal accident insurance is not included in the cost of a course, and you may wish to speak to your own insurance broker about it.
Our responsibility to you
Every effort is made to keep you safe during your course, but you must realistically accept that an accident can happen and cause loss, damage, expense, personal injury or death. Unless shown to be negligent, neither your instructor nor Bryans Motorcycle School is liable to you for any expense, loss, damage, personal injury or death resulting from an accident.
Our liability is limited to damage caused to you by our failure to perform this contract, or by our improper performance of it, unless that failure was the fault of you or a third party, or was due to unusual and unforeseeable circumstances we could not have avoided. That liability is limited to the price paid for the training course.
We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the services we provide.
We supply training for private, non-commercial use. We have no liability to you for loss of profit, loss of business or business interruption.
Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, including your right to have services carried out with reasonable care and skill.
Complaints
Everyone here wants you to get the most out of your training and to enjoy learning. We use your feedback, positive or negative, to improve what we do. We are committed to a high quality of service, and we need you to tell us when we get it wrong. We will listen, take your complaint seriously, and treat it in confidence.
We aim to:
- put things right for you where that is possible and appropriate;
- learn from where we went wrong;
- make sure we do not make the same mistake twice.
We would hope most things can be resolved informally, by talking to your instructor or the Senior Instructor first. If you would rather not, or that does not resolve it, our Office Manager will consider the circumstances and take it forward.
How to complain
Raise your complaint within 10 days of the incident, by any of these routes:
- In person or by phone on 01782 595000, to the Chief Instructor.
- By email to ride@bryansmotorcycleschool.co.uk.
- In writing to Bryans Motorcycle School, Bet 365 Stadium, Stanley Matthews Way, Stoke-on-Trent, Staffordshire ST4 4EG.
We will take account of our duty to promote equality and diversity throughout. Anonymous complaints cannot be accepted.
What happens next
Once you raise a complaint, we will:
- acknowledge receipt of it by letter or email;
- tell you who will be dealing with it;
- tell you what action will be taken;
- tell you when you can expect a resolution;
- keep you informed as your case progresses.
There are two sides to every dispute, so both parties are given the opportunity to set out their version of events, and any allegations or evidence are fully disclosed to both. Every complaint is recorded on our customer complaint log, monitored by the Office Manager until it is resolved. Anyone in a meeting about a complaint has the right to be accompanied and represented by a person of their choice at every stage; our instructors have the same right to be accompanied by the Chief Instructor or another representative. Where a complaint cannot be dealt with by a member of staff, it is escalated to the Office Manager. You will be given the results of any investigation in writing as soon as possible after conclusions are reached.
Any information you give us stays confidential and is used only as part of the complaints process. Only the people directly involved in the complaint and any investigation see the detail, and the identity of everyone involved is protected.
Appeals
If our resolution does not satisfy you, you can appeal to the school's owner within 2 weeks of receiving it. Your appeal should set out why the resolution is unsatisfactory, along with anything further supporting that. The complaint will then be reviewed and a decision given within 4 weeks. That decision is final.
We will not tolerate being physically or verbally abused at any stage of a complaint. Where that happens, we reserve the right to communicate with you only through legal channels, at your expense.
Your personal information
Everything we do with your personal information is set out in our Privacy Policy, including what we collect, why, how long we keep it and how to ask for a copy or have it deleted.
Changes to these terms
We may update these terms from time to time. The version that applies to your booking is the one published on this site when your booking was confirmed. The date at the top of this page tells you when it was last revised.
Governing law
These terms are governed by the law of England and Wales, and any dispute arising from them can be brought in the courts of England and Wales.
